Albuquerque man accused of sexually assaulting student will not be held until trial

ALBUQUERQUE, N.M. (KRQE) – A preschool teacher is facing criminal sexual penetration charges after a five-year-old student told their parents they were being touched. Michael Kimball was arrested last week.

Back in December 2023, a New Mexico Early Learning Academy student told their parents that Kimball touched them in their private area. The state filed for pretrial detention but it was denied by Judge Lucy Solimon. He will remain behind bars until they can get him a GPS monitor and he was also ordered to not be around any minors.
